1. Service Description
Haceme el Favor is a technology platform developed and maintained by Pragmatic Business Solutions, LLC, a Texas-based technology company in the United States. The platform connects people abroad (“Requesters”) with trusted individuals in Nicaragua (“Favorecedores”) to perform errands, tasks, and in-person verifications. The platform facilitates connection, communication, and payment between the parties.
2. We Are NOT a Financial Service
Haceme el Favor is NOT a financial service, remittance service, or money transfer service. We do not transmit, store, or intermediate funds between individuals. Payments are made exclusively for errand and task services through authorized payment processors. We are not a Money Service Business (MSB) and are not subject to FinCEN regulations as a money transmitter.
3. Non-Custodial Model
The platform operates under a non-custodial model. We do not hold user funds. Requester payments are processed directly through authorized payment processors and disbursed to Favorecedores per the established payment cycle, minus the platform commission. At no point does the platform act as a custodian of funds.
4. Eligibility
Requesters: individuals 18 years or older, residing in any country (except OFAC-sanctioned countries). Favorecedores: individuals 18 years or older, residing in Nicaragua with a valid national ID (cédula). Business Accounts: registered businesses in Nicaragua that wish to use the platform for business errands. Must provide business name, owner or manager name, phone number, email, and city. RUC number is optional but recommended. All parties must provide truthful information and keep their data up to date.
5. Nature of the Relationship
Favorecedores are independent individuals who choose to perform favors of their own free will. They are not employees, contractors, or representatives of Haceme el Favor. The platform does not control how, when, or where they perform their work. Favorecedores are responsible for their own tax obligations and do not receive employment benefits from the platform.
5.1. Business Accounts and Favorecedores Empresariales
Businesses in Nicaragua may register a Business Account to post business errands. Business tasks are only visible to and can only be accepted by Favorecedores Empresariales — a special tier earned by merit, not by request.
Requirements to earn the Favorecedor Empresarial tier:
- Minimum 15 personal tasks successfully completed.
- On-time completion rate of 90% or higher.
- Average rating of 4.5 stars or higher.
- 100% GPS proof compliance.
- Zero disputes lost in the last 30 tasks.
- Average acceptance time under 30 minutes.
- Account active for at least 60 days.
The system calculates a Business Readiness Score (0-100) every night. A score of 75 or higher = automatically qualified. If the score drops below 70, the Favorecedor loses access to business tasks with a 7-day grace period.
Business tasks offer higher compensation than personal tasks, reflecting the additional quality and reliability requirements demanded by businesses.
6. Fees and Commissions
The platform charges a commission on each completed transaction:
- Personal favors: ~17% commission on the favor amount, charged to the Requester.
- Business errands: 20% commission on the favor amount, charged to the Business Account. This higher rate reflects exclusive access to pre-qualified Favorecedores Empresariales.
Favor rates are agreed upon between Requester and Favorecedor within the suggested ranges per category. Prices are displayed in US dollars (USD). Payment processors may charge additional fees per their current terms.
7. Payment Methods & Disbursements
Requesters: payments are collected via credit or debit card through Stripe, an authorized payment processor.
Favorecedores: payouts are disbursed exclusively via direct bank transfer through Wise. Favorecedores must have a Nicaraguan bank account (BAC, Banpro, Lafise, or other local bank) in order to receive payments. No other payout method is offered. Without an active bank account, the Favorecedor will not be able to receive payments for completed favors.
Disbursement timeline: funds will be available in the Favorecedor’s bank account within 3 to 5 business days after the Requester confirms completion of the favor. This timeframe is due to the transaction passing through two separate banking systems: from the Requester’s payment processor (Stripe) to the platform’s business account, and then from the platform to the Favorecedor’s bank account via Wise.
Transfer fee: a $6.00 USD fee will be deducted from each payout as an international transfer fee. This amount covers the cost of sending funds from the United States to Nicaragua through Wise.
The platform is not responsible for additional fees charged by the Favorecedor’s receiving bank.
8. Prohibited Tasks
The following activities are strictly prohibited:
- Transporting identity documents (passports, national IDs).
- Transporting cash exceeding $100 USD.
- Purchasing controlled medications.
- Purchasing weapons or illegal substances.
- Tasks involving minors without verified parental consent.
- Entering private residences (except exterior-only verification).
- Loans, currency exchange, or financial transactions.
- Political activities, protests, or surveillance.
- Any activity illegal under Nicaraguan or US law.
Violation of these prohibitions will result in immediate and permanent account suspension.
9. Proof of Completion
Favorecedores must provide photographic and/or documentary proof of completion for each favor. Proof must be authentic, taken in real time, and clearly show the result of the requested favor. Falsified proof will result in permanent suspension.
10. Disputes
Disputes between Requesters and Favorecedores are resolved first through the platform’s mediation system. Parties have 48 hours from delivery to report issues. The platform may issue partial or full refunds based on its evaluation of submitted evidence. Mediation decisions are binding.
11. Termination
Either party may terminate their account at any time. The platform reserves the right to suspend or terminate accounts for violation of these terms, fraudulent activity, or for any reason at its discretion. Pending funds for completed favors will be disbursed per the normal cycle.
12. Limitation of Liability
Haceme el Favor acts solely as a technology intermediary. We do not guarantee the quality, timeliness, or outcome of favors. Our maximum liability is limited to the commission charged for the transaction in question. We are not liable for indirect, consequential, or punitive damages.
13. OFAC Compliance
The platform complies with regulations of the Office of Foreign Assets Control (OFAC) of the US Department of the Treasury. Transactions with individuals, entities, or countries on OFAC sanctions lists are not permitted. We reserve the right to verify users against SDN lists and deny service as applicable.
14. Governing Law
These terms are governed by the laws of the State of Texas, United States, where Pragmatic Business Solutions, LLC operates. For disputes not resolved through mediation, the parties submit to the jurisdiction of the competent courts of the State of Texas.
15. Law 842 — Nicaraguan Consumer Protection
For users in Nicaragua, these terms are interpreted in accordance with Law No. 842, the Law for the Protection of Consumer and User Rights. Favorecedores, as consumers of the platform, enjoy the rights established in said law, including the right to clear information, equitable treatment, and complaint mechanisms.
16. Modifications
We reserve the right to modify these terms at any time. Substantial changes will be notified at least 15 days in advance by email and notice on the platform. Continued use of the service after the effective date constitutes acceptance of the new terms.
