1. Service Description
Haceme el Favor is a technology platform that connects people abroad (“Requesters”) with trusted individuals in Nicaragua (“Favorecedores”) to perform errands, tasks, and in-person verifications. The platform facilitates connection, communication, and payment between the parties.
2. We Are NOT a Financial Service
Haceme el Favor is NOT a financial service, remittance service, or money transfer service. We do not transmit, store, or intermediate funds between individuals. Payments are made exclusively for errand and task services through authorized payment processors. We are not a Money Service Business (MSB) and are not subject to FinCEN regulations as a money transmitter.
3. Non-Custodial Model
The platform operates under a non-custodial model. We do not hold user funds. Requester payments are processed directly through authorized payment processors and disbursed to Favorecedores per the established payment cycle, minus the platform commission. At no point does the platform act as a custodian of funds.
4. Eligibility
Requesters: individuals 18 years or older, residing in any country (except OFAC-sanctioned countries). Favorecedores: individuals 18 years or older, residing in Nicaragua with a valid national ID (cédula). Both parties must provide truthful information and keep their data up to date.
5. Nature of the Relationship
Favorecedores are independent individuals who choose to perform favors of their own free will. They are not employees, contractors, or representatives of Haceme el Favor. The platform does not control how, when, or where they perform their work. Favorecedores are responsible for their own tax obligations and do not receive employment benefits from the platform.
6. Fees and Commissions
The platform charges a commission of 15% on each completed transaction. Favor rates are agreed upon between Requester and Favorecedor within the suggested ranges per category. Prices are displayed in US dollars (USD). Payment processors may charge additional fees per their current terms.
7. Prohibited Tasks
The following activities are strictly prohibited:
- Transporting identity documents (passports, national IDs).
- Transporting cash exceeding $100 USD.
- Purchasing controlled medications.
- Purchasing weapons or illegal substances.
- Tasks involving minors without verified parental consent.
- Entering private residences (except exterior-only verification).
- Loans, currency exchange, or financial transactions.
- Political activities, protests, or surveillance.
- Any activity illegal under Nicaraguan or US law.
Violation of these prohibitions will result in immediate and permanent account suspension.
8. Proof of Completion
Favorecedores must provide photographic and/or documentary proof of completion for each favor. Proof must be authentic, taken in real time, and clearly show the result of the requested favor. Falsified proof will result in permanent suspension.
9. Disputes
Disputes between Requesters and Favorecedores are resolved first through the platform’s mediation system. Parties have 48 hours from delivery to report issues. The platform may issue partial or full refunds based on its evaluation of submitted evidence. Mediation decisions are binding.
10. Termination
Either party may terminate their account at any time. The platform reserves the right to suspend or terminate accounts for violation of these terms, fraudulent activity, or for any reason at its discretion. Pending funds for completed favors will be disbursed per the normal cycle.
11. Limitation of Liability
Haceme el Favor acts solely as a technology intermediary. We do not guarantee the quality, timeliness, or outcome of favors. Our maximum liability is limited to the commission charged for the transaction in question. We are not liable for indirect, consequential, or punitive damages.
12. OFAC Compliance
The platform complies with regulations of the Office of Foreign Assets Control (OFAC) of the US Department of the Treasury. Transactions with individuals, entities, or countries on OFAC sanctions lists are not permitted. We reserve the right to verify users against SDN lists and deny service as applicable.
13. Governing Law
These terms are governed by the laws of the State where Pragmatic Business Solutions, LLC operates, in the United States. For disputes not resolved through mediation, the parties submit to the jurisdiction of the competent courts of said State.
14. Law 842 — Nicaraguan Consumer Protection
For users in Nicaragua, these terms are interpreted in accordance with Law No. 842, the Law for the Protection of Consumer and User Rights. Favorecedores, as consumers of the platform, enjoy the rights established in said law, including the right to clear information, equitable treatment, and complaint mechanisms.
15. Disclaimer of Liability for User Conduct
Haceme el Favor is solely a technology platform that connects individuals who need a favor with individuals willing to perform it. We are not responsible, under any circumstances, for the actions, conduct, omissions, or behavior of any user of the platform, whether Requester or Favorecedor.
This includes, but is not limited to:
- Vandalism, property damage, or destruction of goods
- Harassment, intimidation, threats, or any form of violence
- Theft, fraud, scams, or misappropriation
- Invasion of privacy, espionage, or illegal surveillance
- Any illicit, immoral, or unlawful activity under the laws of Nicaragua or the user's country of residence
- Personal, emotional, financial, or any other type of damages
By using the platform, each user accepts that they act under their own responsibility and risk. Favorecedores are independent individuals who choose to do favors of their own free will. They are not employees, agents, or representatives of Haceme el Favor. Requesters are responsible for the nature of the favors they request.
Haceme el Favor does not supervise, direct, or control the execution of favors. We provide verification tools (GPS, photos, videos) as a transparency mechanism, but this does not constitute supervision or a guarantee of outcome.
If a user uses the platform to facilitate, plan, or execute any illicit act, said user shall be solely legally and criminally responsible. Haceme el Favor will cooperate with competent authorities as required by law.
16. Waiver of Right to Sue, Mandatory Arbitration & Release of Liability
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
By registering for, accessing, or using the Haceme el Favor platform in any way, you freely, voluntarily, and irrevocably agree to the following:
16.1 Complete Release of Liability
You release, discharge, and hold harmless Haceme el Favor, Pragmatic Business Solutions, LLC, its directors, employees, affiliates, agents, and successors (collectively, “the Company”) from any and all claims, demands, legal actions, damages, losses, costs, expenses (including attorney fees), and liabilities of any kind, whether known or unknown, arising from or related to:
- The use of the platform by any user
- The conduct, actions, or omissions of any Requester or Favorecedor
- The execution, outcome, or consequences of any favor requested or performed
- Any interaction between users outside or within the platform
- Personal, material, emotional, financial, or any other type of damages
16.2 Waiver of Right to Sue
You expressly waive your right to file any lawsuit, legal action, or legal proceeding against the Company in any court or jurisdiction, for any claim arising from or related to the use of the platform or the actions of other users. This waiver includes, without limitation, claims for negligence, strict liability, breach of contract, damages, and any other applicable legal theory.
16.3 Mandatory and Binding Arbitration
Any dispute, controversy, or claim arising from or related to these terms, the platform, or its use shall be resolved exclusively and finally by binding arbitration, administered in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in the State where Pragmatic Business Solutions, LLC operates. The arbitrator’s decision shall be final and binding, and may be enforced in any court of competent jurisdiction.
16.4 Class Action Waiver
You agree that any claim or dispute shall be brought only in your individual capacity. You waive your right to participate in any class action, class arbitration, or any other representative proceeding against the Company.
16.5 Assumption of Risk
You acknowledge and agree that use of the platform and the request or performance of favors carries inherent risks. You voluntarily assume all risks associated with the use of the platform, including but not limited to risks of personal injury, financial loss, property damage, or any other harm that may result from the conduct of other users.
17. Modifications
We reserve the right to modify these terms at any time. Substantial changes will be notified at least 15 days in advance by email and notice on the platform. Continued use of the service after the effective date constitutes acceptance of the new terms.
